When at first you don’t succeed…
The Senate chose not to convict former President Trump in his latest impeachment trial, but that’s not stopping some lawmakers from trying to hold Trump accountable for the Capitol riot on January 6.
Representative Bennie Thompson, a Democrat who chairs the Homeland Security Committee, filed a lawsuit on Tuesday accusing former President Donald Trump and lawyer Rudolph Giuliani of conspiring to incite a violent riot.
The lawyers for Thompson said:
“The insurrection was the result of a carefully orchestrated plan by Trump, Giuliani and extremist groups like the Oath Keepers and Proud Boys, all of whom shared a common goal of employing intimidation, harassment and threats to stop the certification of the Electoral College.”
Proving incitement in a court of law requires a much higher burden of proof than it does during an impeachment trial in the Senate, so it seems unlikely that Thompson will prevail.
